Workouts

• The firm works closely with management to design and implement a strategy to negotiate with creditors to achieve a mutually satisfactory workout plan.

Bankruptcy

• The firm assists in filing for the protections under Chapter 7 and 11 of the Bankruptcy Code to provide its clients the most effective means for restructuring a financially distressed company.

Assignment for Benefit of Creditors

• This is a state court insolvency proceeding governed by state law rather than federal bankruptcy law. The firm has represented both Assignors (Debtors) and Assignees (Trustees) in multiple assignment actions.  Most bankruptcy attorneys are not familiar with these procedings and therefore provide a disservice to clients by not exploring all available options.

Creditor Rights

• The firm provides clients with experience and insight to aggressively handle even the most complex bankruptcy litigation matters including cash collateral and adequate protection hearings, valuations, and motions to vacate the automatic stay.

Preference Defense

• The firm has developed expertise in the areas of fraudulent and preferential transfers and other avoidance actions under the Bankruptcy Code.  Because of the experience prosecuting fraudulent and preferential transfers, the firm has the advantage of seeing the issues and more importantly the weaknesses of the “other side.”
